1. About us and these terms
COMFYTIC is the trading name of SILKYSELL LTD, a private limited company registered in England and Wales under company number 16792786. Our registered office is 31 St. Pauls Avenue, Harrow, United Kingdom, HA3 9PR. Our website is https://www.comfytic.com. Email: info@comfytic.com. Telephone: 020 3051 5377.
These terms apply to purchases through https://www.comfytic.com and should be read with our Returns & Refunds Policy and Delivery & Shipping Policy. Our registered office is not a shop, showroom, collection point or returns address. These terms do not take away any statutory consumer right.
2. Who may order and website use
You must have legal capacity to make a binding purchase. Please provide complete, accurate information when ordering and use our website lawfully. Do not attempt to interfere with its security, operation or content.
Our website content, trade marks, text, design and product information may be protected by intellectual property rights. Use of the website does not transfer ownership of those rights to you.
3. Product descriptions and specifications
We aim to describe our electric standing desks, chairs, monitor arms and accessories accurately. Please read the individual product specifications, including dimensions, finishes, weight limits, electrical requirements, available options and assembly requirements, before ordering.
Images may vary slightly from an actual product because of lighting, display settings or natural manufacturing variation. Any material product difference or material error will be addressed in accordance with your legal rights. Standard selectable size or colour variants are not automatically personalised products.
4. Prices, taxes and payment
Prices are displayed in pounds sterling (£ GBP). SILKYSELL LTD is not currently registered for VAT, so VAT is not separately charged and we do not issue VAT invoices. The full price payable, including any delivery charge, is presented before you submit your order.
You may pay using the payment methods presented at checkout. Payment processing is handled through our ecommerce platform and relevant payment providers. If an obvious pricing error is identified before we accept an order, we may contact you and give you the option to order at the correct price or cancel; we will not charge a different price without your agreement.
5. Placing an order and acceptance
When you submit an order you make an offer to purchase the selected products. An automated email confirming receipt of the order is an acknowledgement and does not itself constitute acceptance.
We may need to verify payment, stock and delivery availability. We accept an order when we send an express acceptance or dispatch confirmation, or when we dispatch the goods, whichever occurs first. At that point a contract is formed. This contract-formation process does not affect rights that arise before or after acceptance under applicable law.
If we cannot accept your order because of unavailable stock, delivery restrictions, suspected fraud, a material listing error or other legitimate reason, we will inform you and return any money already taken for that order.
6. Product availability and substitutions
Stock shown on our website may change before an order is processed. Some products are supplied directly from UK manufacturers or distributors. We do not promise live, real-time stock availability unless we expressly state this for a product.
If a product becomes unavailable, we may offer an alternative, a revised delivery period or cancellation. We will not send a materially different substitute without your consent.
7. Delivery
We offer delivery to eligible mainland Great Britain addresses, subject to product and postcode restrictions. We do not currently offer standard delivery to Northern Ireland, the Scottish Highlands and Islands, the Channel Islands or the Isle of Man. Delivery charges and service levels depend on the item and destination and must be explained before purchase. Large furniture may be delivered kerbside or to a building or ground-floor access point. Room-of-choice delivery, assembly or installation is included only when expressly offered and agreed.
Unless we agree a different delivery period with you, goods must be delivered within 30 days after contract formation. We remain responsible for the goods until you or someone you nominate takes physical possession of them, except where the law provides otherwise. Our Delivery & Shipping Policy explains dispatch arrangements, access requirements, delays and damaged deliveries.
8. Cancellation and returns
Consumers normally have 14 days after receiving goods to notify us that they are cancelling a distance purchase without giving a reason, followed by a further 14 days to send back the goods, subject to lawful exceptions. The change-of-mind exception for goods made to a customer’s specifications or clearly personalised does not automatically extend to ordinary selectable colours, sizes or finishes. You may contact us to request order changes or cancellation before dispatch; changes cannot always be made once processing has started, but statutory rights remain intact.
For statutory change-of-mind cancellations, you may have to pay the direct cost of returning goods only where that responsibility was properly explained before purchase. For large items that cannot normally be returned by post, any direct specialist return cost or reasonable estimate for which you are responsible must be disclosed before purchase. If the required information was not supplied, COMFYTIC will bear the direct return cost. Further details, including standard outward delivery refunds and refund deadlines, appear in our Returns & Refunds Policy.
9. Faulty goods and warranties
Products must meet the standards required by the Consumer Rights Act 2015. You may have a short-term right to reject non-conforming goods, rights to repair or replacement, and further remedies where the law applies. A manufacturer warranty is additional to, and does not replace, your legal rights against us.
If goods are faulty, damaged on arrival, materially misdescribed or have missing components, contact info@comfytic.com. We will consider an appropriate statutory remedy, which may be a repair, replacement, price reduction or refund, depending on your legal rights. A supplier or manufacturer parts-only warranty cannot remove COMFYTIC’s responsibilities as your retailer.
10. Assembly and safe use
Please check the product’s dimensions, weight, access requirements and safety or assembly instructions before use. Any separately offered installation or assembly service must be expressly agreed, including its scope and charge. Do not attempt unsafe modifications to electrical or height-adjustable furniture.
11. Responsibility and liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or statutory consumer right that cannot legally be excluded or limited.
We are responsible for foreseeable loss or damage caused by our breach of contract or failure to use reasonable care and skill, subject to applicable law. Where goods are bought by a consumer for personal use, we do not seek to exclude remedies or liabilities that consumer law protects. If you are purchasing mainly for business use, please contact us for any specific business supply arrangements.
12. Complaints and contact
If you have a complaint about an order, delivery, refund or product, contact info@comfytic.com with the order number and a description of the concern. You may also telephone 020 3051 5377 during our customer service hours: Monday to Friday, 9:00 am to 5:00 pm UK time, excluding public holidays. We will review your concern and explain the next steps.
13. Applicable law
These terms are governed by the laws of England and Wales, except that you retain any mandatory consumer protections that apply in the part of the United Kingdom where you live. Nothing in this clause deprives you of the right to bring proceedings in a court that has jurisdiction under applicable consumer law.
